Overview

This Privacy Policy describes Not Your Mother’s (owned by DeMert Brands) (“NYM”) policies regarding the collection, use, and disclosure of information about you in connection with your use of our website (www.notyourmothers.com) (the “Site”) and the products provided directly to our Customers (the “Services”). For the general Internet user and potential Customer, the Personal Information we collect and the practices described above are undertaken in an effort to provide you with the best experience possible, protect you from risks related to improper use and fraud, and help us maintain and improve NYM’s offerings.   • Provide You with NYM NYM uses your Personal Information to provide you with its Products, Services, and Site pursuant to its Terms of Use for the Site and this Privacy Policy.
  • Comply with Legal and Regulatory Requirements.NYM processes your Personal Information as required by applicable laws and regulations.

For our Customers, we may use the Personal Information we collect or receive through the Service (alone or in combination with other data we source) for the purposes and on the legal bases identified below: 

  • To perform our contract with you for the purchase or use of the Products or Services or where we have not entered into a contract with you, in accordance with our legitimate interests to operate and administer our Services. 
  • To enforce compliance with our contractual obligations and applicable law, and to protect the rights and safety of our Customers in reliance on our legitimate interest to protect against misuse or abuse of our Services and to pursue remedies available. 
  • To meet legal requirements, including complying with court orders, valid discovery requests, valid subpoenas, and other appropriate legal mechanisms. 
  • To provide information to representatives and advisors, including attorneys and accountants, to help us comply with legal, accounting, or security requirements in reliance on our legitimate interests. 
  • To prosecute and defend a court, arbitration, or similar legal proceeding. 
  • To respond to lawful requests by public authorities, including to meet national security or law enforcement requirements.
  • To provide, support, and improve the Products and Services to perform our contract with you for the use of the Services or where we have not entered into a contract with you, in reliance on our legitimate interests in administering and improving the Site and Services and providing certain features. When we share your Personal Information with third parties, we take steps to protect your information in a manner that is consistent with our obligations under applicable privacy laws.
  • To combine and anonymize data about our Customers and our Customers’ use of the Services in order to create aggregate, anonymized statistics, which we may use to provide certain features within the Services and for promoting and improving the Services in reliance on our legitimate interests.

How We Share the Information We Collect

NYM will not share your Personal Information with third parties, except as described below.

  • Third-Party Service Providers and Vendors.NYM may share your Personal Information with third-party service providers for business or commercial purposes. Your Personal Information may be shared so that they can provide us with services, including identity verification, fraud detection and prevention, security threat detection, payment processing, Customer support, data analytics, Information Technology, advertising, marketing, data processing, network infrastructure, storage, transaction monitoring, and tax reporting. NYM shares your Personal Information with these service providers only so that they can provide us with their services, and we prohibit our service providers from using or disclosing your Personal Information for any other purpose. Our third-party service providers are subject to strict confidentiality obligations.
  • Law Enforcement.NYM may be compelled to share your Personal Information with law enforcement, government officials, and regulators.
  • Corporate Transactions.NYM may disclose Personal Information in the event of a proposed or consummated merger, acquisition, reorganization, asset sale, or similar corporate transaction, or in the event of a bankruptcy or dissolution.

How to Make Data Requests - Information for California Residents

NYM is required under the California Privacy Rights Act of 2020 (“CPRA”) to provide certain information to California residents about how we collect, use, and share their Personal Information, and about the rights and choices California residents may have concerning their Personal Information. For purposes of this section, “Personal Information” has the meaning provided in the CPRA.

Right to Access; Right to Access Information on Automated Decision-Making

You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past twelve (12) months (the "Right to Access").

You may submit a request that NYM disclose the categories and specific pieces of Personal Information that we have collected, used, or disclosed about you in the past twelve (12) months, or Personal Information we have collected on or after January 1, 2022, unless doing so is impossible or involves disproportionate effort.

Without having to submit a request to access your Personal Information, you have the right to know what categories of Personal Information we have collected from you generally within the past twelve (12) months, or categories of Personal Information we have collected from you on or after January 1, 2022, including where we got it, why we collected it, and with whom we shared it.

Please note that simply because NYM has provided the categories of Personal Information it may collect pursuant to California law does not mean NYM necessarily collected all of the specific pieces of Personal Information listed for any given person. Also, please note where Personal Information was disclosed within the past twelve (12) months, it may have been disclosed only to service providers.

Once we receive your request and confirm your identity, we will disclose to you: 

·       The categories of Personal Information we collected about you.

·       The categories of sources for the Personal Information we collected about you.

·       Our business or commercial purpose for collecting or selling that Personal Information.

·       The categories of third parties with whom we share that Personal Information.

·       If we disclosed your Personal Information for a business purpose, identifying the Personal Information categories that each category of recipient obtained.

Right to Delete

You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions (the "Right to Delete"). 

Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

·       Take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.

·       Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

·       Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).

·       Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us.

·       Comply with a legal obligation.

·       Make other internal and lawful uses of that information that are compatible with the context in which you provided it. 

We will delete or de-identify Personal Information not subject to one of these exceptions from our records and will direct our service providers to take similar action.

Right to Correct

You have the right to request that we correct any of your Personal Information that we collected from you and retained, subject to certain exceptions (the "Right to Correct").

Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies. We may deny your correction request if retaining the information is necessary for us or our service provider(s) to: 

·       Take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you. 

·       Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

·       Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.). 

·       Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us. 

·       Comply with a legal obligation.

·       Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

We will correct your Personal Information not subject to one of these exceptions from our records and will direct our service providers to take similar action. 

Right to Opt-Out of the Sharing of Personal Information

You have the right to request to opt-out of the sharing of Personal Information that may be collected and used, subject to certain exceptions (“Right to Opt-Out”).

Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies. We may deny your opt-out request if retaining the information is necessary for us or our service provider(s) to:

 ·       Take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.

 ·       Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

·       Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).

·       Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us.

·       Comply with a legal obligation.

We will opt you out of the sharing of your Personal Information not subject to one of these exceptions from our records and will direct our service providers to take similar action. 

We have not “sold” Personal Information within the past twelve (12) months, as that term is defined by the CPRA. 

Right to Limit the Disclosure of Sensitive Personal Information

You have the right to request that we limit the disclosure of certain sensitive Personal Information about our collection and use of your Personal Information over the past twelve (12) months pertaining to information that may be collected and used, subject to certain exceptions (“Right to Limit Disclosure of Sensitive Personal Information”).

Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies. We may deny your limitation request if retaining the information is necessary for us or our service provider(s) to:

·       Take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you. 

·       Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

·       Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).

·       Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us. 

·       Comply with a legal obligation. 

·       Make other internal and lawful uses of that information that are compatible with the context in which you provided it. 

We will opt you out from the disclosure of your sensitive Personal Information not subject to one of these exceptions from our records and will direct our service providers to take similar action. 

Right to Non-Discrimination

We will not discriminate against you for exercising any of your CPRA rights.

Exercising Your Rights and Choices

To Exercise

To exercise your rights as described above, please submit a request by either:

Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your Personal Information. 

You may only submit a request to know twice (2) within a twelve (12) month period. Your request to know or delete must:

·       Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative; and 

·       Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. 

NYM is legally obligated to verify your identity when you submit a request. We may request additional information from you to verify your identity. If you submit a request to delete your Personal Information, you will also be required to confirm the deletion request by email. 

You may designate an authorized agent to make a request under the CPRA on your behalf. Your authorized agent must submit proof that you have provided them with power of attorney pursuant to California Probate Code Sections 4000 to 4465. NYM may deny a request from a purported authorized agent who does not provide proof of authorization to act on your behalf.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. 

We will only use Personal Information provided in the request to verify the requestor's identity or authority to make it.

Response Timing and Format

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the ten (10) day timeframe, please contact privacy@nymbrands.com

We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another forty-five (45) days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the twelve (12) month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. Please understand that we are not obligated to provide you with a copy of your Personal Information more than twice in a twelve (12) month period pursuant to the CPRA.

For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, specifically a .csv or .pdf file.

 

Information for Nevada Residents

Nevada law (SB 220) requires website operators to provide a way for Nevada consumers to opt out of the sale of certain information that the website operator may collect about them. NYM does not sell your personal information to third parties as defined in Nevada law, and will not do so in the future without providing you with notice and an opportunity to opt-out of such sale as required by law. Retention of Data

NYM retains Personal Information where we have an ongoing legitimate business or legal need to do so. Our retention periods will vary depending on the type of data involved, but, generally, NYM refer to these criteria in order to determine retention period:

  • Whether we have a legal or contractual need to retain the data;
  • Whether the data is necessary to provide our Products, Services, or Site; and
  • Whether our Customers would reasonably expect that we would retain the data until they remove it or until their accounts are closed or terminated.

When we have no ongoing legitimate business need to process your Personal Information, we will either delete or anonymize it or, if this is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible.

Children’s Privacy

NYM’s Site is not intended for general audiences and is not directed to children under 17. We do not knowingly collect Personal Information from children under 17 through the Site. If you become aware that a child has provided us with Personal Information without parental consent, please contact us at privacy@nymbrands.com. If we become aware that a child under 17 has provided us with Personal Information without parental consent, NYM takes steps to remove such information.

Security

No security is foolproof, and the Internet is an insecure medium. We cannot guarantee absolute security, but we work hard to protect NYM and you from unauthorized access to or unauthorized alteration, disclosure, or destruction of Personal Information that we collect and store.

NYM addresses its guarantees as to privacy and security in the various agreements and data processing addendum that it enters into contractually with its Customers.

The NYM Site uses third-party applications and integrations to enhance its customer service experience. NYM disclaims any and all liability and responsibility for the use of these applications and integrations, and encourages you to review their individual privacy policies before using the NYM website, purchasing products from NYM, or otherwise engaging with NYM:

Use of Tools That Collect Biometric Data

NYM may use certain biometric tools to enhance the consumer experience with its various products. Through the implementation of third-party technologies, including, but not limited to, Perfect (https://www.perfectcorp.com/business), virtual artificial intelligence tools are provided to you to assess your hair attributes and condition and make recommendations of NYM’s products.

NYM may revise this Privacy Policy from time to time.
